Privacy policy

This privacy policy ("Policy") describes how ITG Tecnologie s.r.l. ("ITG Tecnologie s.r.l.", "we", or "our") collects, protects, and uses personally identifiable information ("Personal Information") that you ("User "you" or "your") may provide on the top-gears.co.uk website and any of its products or services (collectively, the "Website" or "Services").

It also describes the choices available to you regarding the use of your Personal Information and how you can access and update this information. This policy does not apply to the practices of companies we do not own or control, or to people we do not employ or manage.

Autonomous collection of information

Our main priority is the security of customer data and, as such, we exercise a 'no logs' policy. We process only minimal user data, only to the extent that it is absolutely necessary to maintain the Site or Services. Automatically collected information is used only to identify potential instances of abuse and to establish statistical information regarding the use of the Website. Such statistical information is not otherwise aggregated in such a way as to identify a particular user of the system.

Collection of personal data

You can visit the site without telling us who you are or revealing any information by which someone might identify you as a specific, identifiable individual. If, however, you wish to use some of the features of the website, you will be asked to provide certain personal information (for example, your name and e-mail address). We receive and retain all information that you knowingly provide when you create an account, make a purchase, or complete any online form on the Website. If necessary, such information may include:

- Contact information such as e-mail address, address, etc.

- Account-related information such as user name, unique user ID, password, etc.

- Payment information such as credit card data, bank details, etc.

You can choose not to provide us with your personal information, but you may not be able to take advantage of some of the features of the site. Users who are unsure what information is mandatory are invited to contact us.

Storing personal information

We will retain and use your personal data for the period necessary to comply with our legal obligations, resolve disputes and enforce our agreements, unless a longer retention period is required or permitted by law. We may use any aggregate data derived from or incorporating your personal data after it has been updated or deleted, but not in a way that personally identifies you. Once the retention period has expired, your personal data is deleted. Therefore, the right of access, the right to erasure, the right to rectification and the right to data portability cannot be applied after the retention period has expired.

In any case, we will be happy to clarify the specific legal basis that applies to the processing, and in particular whether the provision of personal data is a legal or contractual requirement, or a requirement to enter into a contract.

Transfer and storage of information

Depending on the location, the data transfer may involve the transfer and storage of information in a country other than your own. You have the right to know the legal basis for transfers of information to a country outside the European Union or to any international organisation governed by public international law or established by two or more countries, such as the UN, and about the security measures we take to safeguard your information. If such a transfer does take place, you can find out more by checking the relevant sections of this document or inquire with us using the information provided in the contact section.

This provision shall apply provided that the information is processed by automated means and the processing is based on your consent, a contract to which you are a party or pre-contractual obligations.

The right to object to processing

Where personal data are processed for the public interest, for the exercise of an authority vested in us or for the purposes of the legitimate interests pursued by us, you may object to such processing by providing a reason relating to your particular situation to justify the objection. You should be aware, however, that if we are processing your personal data for direct marketing purposes, you may object to such processing at any time without providing any justification. To find out whether we are processing personal data for direct marketing purposes, please refer to the relevant sections of this document.

How to exercise these rights

Any request to exercise the User's rights may be addressed to the Data Controller via the contact details provided in this document. These requests may be exercised free of charge and will be addressed by the Data Controller as soon as possible.

Invoicing and payments

In the case of services requiring payment, we require credit card or other payment account information, which will be used exclusively for payment processing. Purchase transaction information is only stored for as long as it is needed to complete the purchase transaction. After it is complete, the purchase transaction information is deleted. If necessary for future payment processing and with your consent, your financial data will be stored in encrypted form on secure servers of our payment gateway service provider who is obliged to process your personal data in accordance with this Privacy Policy. All direct payment gateways adhere to the latest security standards administered by the PCI Security Standards Council, which is a joint effort of brands such as Visa, MasterCard, American Express and Discover. The exchange of sensitive and private data takes place via an SSL-secured communication channel and is encrypted and protected with digital signatures, and our website is also in compliance with PCI vulnerability standards in order to create the safest possible environment for users. Malware scans are performed on a regular basis for added security and protection.

Children's privacy

We encourage parents and legal guardians to monitor their children's Internet usage and help enforce this policy by instructing their children never to submit any personal information through our website or service without their permission.

If you have reason to believe that a child under the age of 13 has provided us with personal information through our website or service, please contact us. You must also be at least 16 years of age to consent to the processing of your personal data in your country (in some countries we may allow your parents or guardians to do this on your behalf).

These companies may provide ads that may also place cookies and otherwise track user behaviour.

Non-tracking of signals

Some browsers incorporate a Do Not Track function that signals to visited websites that you do not wish to have your online activity monitored. Tracking is not the same as using or collecting information in relation to a website. For this purpose, tracking refers to the collection of personally identifiable information from consumers who use or visit a website or online service as they move through different websites over time. Our website does not track its visitors over time or through third-party websites. However, some third-party sites may track your browsing activities when serving content, which allows them to customise what they present to you.

Affiliates and associates

We may disclose information about you to our affiliates and subsidiaries in order to be able to offer related or additional products and services. Any information about you that we provide to our affiliates will be treated by those affiliates in accordance with the terms of this Privacy Policy.

We secure the information provided on computer servers in a controlled and secure environment, protected from unauthorised access, use or disclosure. We maintain reasonable administrative, technical and physical safeguards in an effort to protect against unauthorised access, use, modification and disclosure of personal information in its control and custody. However, no data transmission over the Internet or wireless network can be guaranteed. Therefore, while we strive to protect your personal information, you acknowledge that (i) there are Internet security and privacy limitations that are beyond our control; (ii) the security, integrity, and privacy of all information and data exchanged between you and our website cannot be guaranteed; and (iii) such information and data may be viewed or tampered with in transit by a third party, despite our best efforts.

In the event of a data breach, we will make reasonable efforts to notify affected individuals if we believe there is a reasonable risk of harm to you as a result of the breach or if notification is otherwise required by law. When we do so, we will post a notice on the site.

Legal Disclosure

We will disclose any information we collect, use or receive if required or permitted by law, such as complying with a subpoena, or similar legal process, and when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request. In the event we go through a business transition, such as a merger or acquisition by another company, or the sale of all or a portion of its assets, your user account and personal information will likely be among the assets transferred.

Changes and amendments

We may update this privacy policy from time to time at our discretion and will notify you of any material changes to the way we process personal data. When changes are made, we will revise the updated date at the bottom of this page. At our discretion, we may also notify you in other ways, such as through the contact information you provide. Any updated version of this Privacy Policy will take effect immediately upon posting of the new Privacy Policy, unless otherwise specified.
